GRAYMONT INJUNCTION

We filed our suit on March 17 seeking an injunction against the transfer of over 11,000 acres of public land –1836 Ceded Territory– to Graymont Mining.   The suit is now on PACER.

The Judge denied our Motion for a Temporary Restraining Order, but did say this: “The nature of the claim Plaintiffs are attempting to assert pro se appear to touch on both procedural and substantive provisions of the Consent Decree.”  He referred the matter to the Court’s Magistrate to see whether or not it should be assigned to Chief Judge Maloney, as he is now overseeing the Consent Decree. The Judge explained that this is SOP for pro se filings.

LATEST NEWS –Judge sets hearing date on Graymont Injunction
Despite media reports, this case is far from over.  The judge did dismiss our 2nd request for a Temporary Restraining Order, but, he did order a Hearing, now set for Wednesday, April 29, 2015, at 3:00 p.m., 174 Federal Building, 410 W. Michigan Ave., Kalamazoo, MI 49007.

The Order contains this language: “Also, there is no indication that the mine will irreversibly alter the land before the lawsuit progresses; the transfer of title alone is not irreparable harm because the Court could reverse the sale.”

We motioned for a Default Judgement on the 22nd.  The Defendant failed to respond to our Complaint within the 21-day deadline, as required by Court Rules –the papers we filed can be viewed here (there were others that are irrelevant for now):
